    The actual court finding is a ruling that Deathifier can notify (Serve papers) Dave Dobson by Facebook or Ark forum, that he is sueing Arkadia Studios and Dave as managing director. Normally you would need to physically hand the papers to the person being sued but his lawyers were unable to locate Dave despite the information that is publicly available online.

    The actual suit appears to be in relation to copyright infringement and breach of contract.

    Deathifier was a pre-launch investor in Planet Arkadia and received ownership of 8Coins. At some stage Ark Studios took back control of the LA for reasons that are between them and Deathifier. I don't know anything about the copyright issues.

    BTW, I don't reckon you will see anyone from the Devs commenting while there are legal proceedings underway.

    What's worst case scenario (even if it has a very low chance of happening)? In case of a lost lawsuit could eventually Arkadia Studio have to pay a large enough sum to force them to fill for bankruptcy or something like that? In this case what would happen with our assets here - as in AUDs, apartments, shops, land areas or whatever? Is there anything that we should be even marginally worry about?

    I doubt bankruptcy would happen, however if it were to happen I think MA might take over the planet. I doubt it will be removed from the game, incase this does happen then I guess you are entitled to the TT value of your assets to be returned to you or ,worst case scenario, that you get nothing in return looking at EULA rule 4.2

    However though, I don't see any reason for concern.

    There's no point in speculating on the outcome. We don't know the details of the case and it may not even go to court if the involved parties can come to an agreement.

    Since deeds have no TT value, the last two options are basically the same.

    And yeah, I am well aware that it's unlikely things would go south so far... there's a (high) chance Arkadia Studios will win the lawsuit, there's a (high) chance they will come to an agreement, there's a (high) chance they will afford to pay what he asks for, even if they lose.

    Thing is that if there is even the sightliest chance (like under 0.01%) chance on loosing my assets, I'd rather sell now than facing the risk. I just hate risks, even minor risks, even tiny risks. So I was talking about worst case scenario (even if highly unlikely); I would sleep much more relaxed knowing that if Arkadia Studios goes belly up, the planet (and our assets on it) won't just "vanish" from the system, but it will go back to MA (or something like that), especially since, at this very moment, for reasons that I'm probably not allowed to mention on this forum, my trust in MA is much higher than my trust in Ark Studio. And basically my question stands... what should be worst we can fear (not necessarily expect).

    Worst case is it sparks the zombie apocalypse. But the likelihood?

    Life is full of risks and there is no point stressing about what might be. Our best opportunities in life come from accepting risk and the possibility of failure.

    Has anyone lost any assets because of being born on Next Island, or because of said assets being located on Next Island?

    Not really.

    Some people have incurred loss buying NI assets that were bugged (shops) or of dubious title (LAs) but that happened after NI keeled over.

    The worst case scenario is nothing much happens for the next few years.

    I expect the agreement between Ark Studio and MA to superscede whatever was agreed with Deathifier. So at worst, if Ark Studio losses, they will by out a bunch of cash only.

    If in the worst case scenario, assuming Arkadia loses for zillions of dollars, I expect MA to take over Planet Arkadia. Similar to Next Island.

    And all your ingame asserts will still be with you.

    If for some reason (probably as much chance as your winning the lottery 3 times in a row, lol) the planet itself goes "poof" and disappears, I expect you will find all your inventory and your avatar to be transfered to another planet (probably calypso). In which case most of the ark specific stuff will probably appreciate in MU cos of rarity, although AUDs may lose value since there is no more underground to get earnings from. But I really really doubt this will happen.

    I expect things to proceed as per normal ingame. And you dont have to worry about Ark Studio reducing loot, etc to help pay for stuff, since loot is controlled by MA and MA is not a party to this legal suit.

    Am from Singapore, so maybe I can provide a couple of comments on the local justice system.

    We don't have the insane seeming multi million dollar damages awarded (like in the US) for minor / small stuff. So I very much doubt the Arkadia Studio is going to face that much of an issue even if the worst happens.

    Since none of us know anything about this court case I'm not sure what information you may be looking for. There is always the risk with this game that someone at MA (or somehow elected into a Virtual Office) will make a bad decision and make it not financially viable for MA to continue operations but I doubt there is much to worry about with this lawsuit. Deathifier gets less from his other investments if he kills Ark completely so I don't expect him to be too greedy.

    Life is full of risks (Big, Small, ect) and nothing is certain. You need to decide what level of risk you are willing to live with and 0% is never an option.

    I wouldn't worry about it, worse case scenario would be MA taking control of Arkadia but i would be extremely surprised if was such an amount to send A-team bust.

    Whatever the disagreement is we most probably won't find out details until after everything is settled (if anything at all). While legal action is underway they are probably advised to say nothing and let the legal people either side wrangle it out.

    All is fine the sky is not falling here. What would happen if Arkadia did pull out of game would be as we see NI now. Arkadia would become a dead planet yet all items on planet would still have value. The only items we would see change would be the AUDs and that is if they are not automated payouts.

    I do not agree with making the findings of the potential lawsuit public.

    As long as it would not affect the players of the game, Arkadia Studio's should have had the possibilities to keep this to themselves. If this case would indeed be affecting the players of the game, than it is Arkadia Studio's own responsibility to inform the players.

    I remember there was a thread about arkadia team bought back 8 coins from deathifier, that should be around the time when pre-launch LA needs to consume fertilizer to spawn mobs.
    I guess it's probably like it, deathifier designed/made the scoria texture and some other things, and let A-team to use it ingame, when the deal closed deathifier asked a-team to change the texture of scoria, maybe even scoria itself. But a-team thought of only scoria texture belongs to deathifier not the entire mobs hence the lawsuit goes in.

    Guess it may be a cultural difference, but at least in my country any information concerning lawsuits is considered public information, and any interested person can consult it online, offline or even attend the court trials in person; also, the info I presented was 100% public info, which was picked up even by the official PCF news bot here.

    As an investor in assets on Arkadia I know for sure that I want to know as much info as possible about any event that may threaten my investments, and I'm quite sure that most people that have invested in AUDs, apartments, shops, land areas think the same. And while I know that we'll probably not get any answer from DEVs, I would really appreciate if they would be more transparent - you know, something like MindArk does with publishing their annual financial info.

    No you didn't. You helped fund marketing and additional content development post launch. Arkadia was well and truly established long before the deeds ever existed.

    Guys, it's pointless speculating how these court proceedings will affect things down the track. Only the parties involved truly know what is going on and, at the end of the day, it is up to them to share once proceedings are complete.

    Until then, people should just play the game as they see fit and ignore all the fuss until there are hard facts made public.
